Terms of Service
These Terms govern your use of threxus.com and every Threxus service, including Threxus Private coaching, Threxus Collective, the Threxus app and free programs, and any future programs (together, the "Services"). The Services are provided by Threxus LLC ("Threxus," "we," "us"). By applying, purchasing, or using the Services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old to use the Services. Coaching programs such as Threxus Private are offered by application, and we may accept or decline any application at our discretion.
2. Not medical advice
Threxus provides fitness, performance, nutrition, and mindset coaching. We are not doctors, physical therapists, dietitians, or mental health providers, and nothing we provide is medical advice, diagnosis, or treatment. Consult a physician before beginning any exercise or nutrition program, especially if you are pregnant, have a medical condition, take medication, or have a history of injury.
3. Assumption of risk
Physical training carries inherent risks, including injury, illness, and in rare cases death. You are responsible for training within your abilities, using proper equipment and technique, stopping if you feel pain or discomfort, and telling your specialist about any injury, condition, or change in your health. You voluntarily assume all risks of participating, and release Threxus and its specialists from claims arising from your training, to the fullest extent permitted by law.
4. Your specialist
Coaching may be delivered by Gavin Adin or by another Threxus specialist. We match clients with specialists based on their goals and may reassign a specialist when needed to keep your coaching consistent.
5. Payments and billing
Prices, billing frequency, and any commitment term are shown at the time of purchase or in your coaching agreement. By purchasing, you authorize recurring charges to your payment method until your membership ends. Payments are processed by a third-party provider. We may change prices with at least 30 days' notice; changes do not affect a commitment term you have already started.
6. Guarantees, cancellations, and refunds
Each program's guarantee, commitment term, and cancellation terms are shown at purchase. Unless your purchase states otherwise:
- Threxus Private: includes a 3-month initial commitment. If you are not satisfied within your first 30 days, contact us and we will refund your payment in full. After 30 days, the remainder of the initial commitment is non-refundable. After the initial commitment, you may cancel with 30 days' written notice.
- Memberships and app subscriptions: you may cancel at any time, effective at the end of the current billing period. Payments already made are non-refundable.
- Cancellations are made by emailing support@threxus.com or through your account where available. Missed sessions or unused coaching time do not carry over or create a credit.
7. Your responsibilities
You agree to give accurate information, follow the program as designed or tell your specialist when you cannot, and treat specialists and other members with respect. We may suspend or end access for abusive conduct, non-payment, or misuse of the Services.
8. Results
Results vary based on effort, consistency, genetics, health, and other factors. Testimonials and examples are individual experiences, not promises. We do not guarantee any specific result.
9. Our content
All programs, workouts, videos, documents, and branding are owned by Threxus and licensed to you for personal use only. You may not copy, resell, share, or redistribute them without written permission.
10. Messages
By providing your contact details, you agree to receive emails about your application, appointments, and Services. Text messages are sent only with your consent, as described in our Privacy Policy. You can unsubscribe from marketing at any time.
11. Third-party services
The Services rely on third-party tools, including our booking, payment, and coaching app platforms. We are not responsible for their availability or practices.
12. Limitation of liability
To the fullest extent permitted by law, Threxus is not liable for indirect, incidental, or consequential damages. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the 3 months before the claim arose.
13. Indemnity
You agree to cover Threxus for claims, losses, and costs arising from your misuse of the Services or your violation of these Terms.
14. Governing law
These Terms are governed by the laws of the State of Connecticut. Any dispute will be brought in the state or federal courts located there.
15. Changes
We may update these Terms from time to time. The "Last updated" date shows the latest version. Continuing to use the Services after a change means you accept the updated Terms.
